The immediate past Commissioner for Insurance, Chief Okechukwu Chukwulozie has instituted a N100million lawsuit before a Federal high court, Abuja, against the Minister of Finance and the National Insurance Commission (NAICOM) over what he called his “unjust and illegal” removal from office.
He is begging the court to annul his sack and reinstate him into office with immediate effect.
Pending his reinstatement, he is also seeking an order stopping the Finance Minister from appointing anybody in his place as commissioner for insurance.
In the writ of summons filed at the registry of the high court by his lawyer, Mr Tayo Oyetibo (SAN), Messrs Bala Zakari Yau and Jubril Zerewa were also named as defendants in the case.
The duo of Yau and Zerewa were Chairman and Secretary respectively of a Federal Government investigation panel that investigated Chukwulozie’s tenure, indicted him and recommended his removal from office.
They were sued as individuals and representatives of the investigation panel.
In a 20-point statement of claim accompanying his writ, the former Commissioner alleged that he was not given fair hearing by the panel that investigated his tenure.
He said his sack breached the principle of natural justice.
For instance, he said that the complaints and petitions which formed the basis for his removal were not made available to him and that even up to the time he appeared before the panel, he did not have access to them.
